AGREEMENT: FishStix Properties L.L.C., the Owner, and Tenant agree as follows: Above Tenant is at least twenty-five (25) years of age (an "adult") and will be an occupant of one and/or both of the units the "FishStix House and The Grouper Getaway" during the entire reserved dates. In addition to Tenant, other authorized occupants may be family members or friends of Tenant. Use of the premises will be denied to persons not falling within the foregoing categories. Should any unauthorized persons occupy or use the Premises, Tenant shall vacate the premises immediately without any refund. No key will be issued to anyone who is not an adult.
RESERVATIONS may be placed up to two (2) years in advance, but are subject to the rates in effect for the year said reservations are placed.
FISHSTIX AND THE GROUPER GETAWAY are rented on a "weekly only" basis during the summer season. There is a three (3) night minimum on rentals during all other seasons, unless otherwise specified.
ADVANCE RENT DEPOSIT is required when placing your initial reservation. The rent deposit is equal to 50% of the total rental fee (excluding sales tax, and security/damage deposit). Rent balance, including sales tax and security/damage deposit is due in full at least twenty-one (21) days preceding Tenant check-in. Payment may be made by check, money order, cashier's check, all payable to FishStix Properties L.L.C., or credit card (Visa or MasterCard accepted).
SECURITY/DAMAGE DEPOSIT is $600 for FishStix and $300 for The Grouper Getaway. Your security/damage deposit will be fully refunded (by the same method of payment), within two to three weeks of your departure, provided all rules and regulations stated herein were observed. All rent deposits and security/damage deposits will be deposited in owner's interest bearing account to the benefit of the owner.
ENTRY BY OWNER: Owner or owner's agents may enter the premises under the following circumstances: in case of an emergency; to make any necessary or agreed upon repairs, alterations, or improvements; supply necessary or agreed upon services or show the premises to prospective purchasers, renters or contractors. Owner will provide renter with at least 24 hours notice of Owner's intent to enter except in the case of an emergency.
RULES AND REGULATIONS:
Tenant and any guest of tenant shall obey all of the laws of the state of Florida, as well as local laws, at all times while they are on the premises. Failure to abide by the laws of Florida or the above rules may cause tenant to be asked to vacate the premises and forfeit all rents and security/damage deposits.
SLEEPING CAPACITY/DISTURBANCES: Tenant and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the sleeping capacity of ten people in FishStix or four people in The Grouper Getaway, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts which interferes with neighbors' right to quiet enjoyment of their premises.
ONLY ADULT RENTALS are allowed. No units will be rented to vacationing students or singles under the age of 25, unless they are accompanied by an adult guardian or parent who remains on the premises for the entire stay. Reservations made under false pretenses may be subject to forfeiture of advance rental payments and/or security/damage deposit.
HOLD HARMLESS: FishStix Properties L.L.C., the Owner, does not assume any liability for loss, damage or injury to persons or their personal property. Neither does owner accept liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, electricity or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond its control.
CANCELLATIONS: The Advance Rent Deposit will not be refunded unless the premises is re-rented for the same rental payment and time period reserved by Tenant. If refunded, there will be a $100.00 cancellation fee per house withheld from the Advance Rent Deposit. We highly recommend obtaining vacation loss insurance.
REFUNDS of the Advance Rent Deposit and/or the Total Rental Fee will not be given for late arrivals, early departures or inclement weather conditions. In the event of a hurricane, refunds will be made only in the event of a mandatory evacuation by governmental authorities. Voluntary evacuations will not receive a refund. Refunds will be granted from the day of the issuance of the mandatory evacuation.
CHECK-IN TIME begins at 4 p.m. and every effort will be made to have the premises ready on time. If you arrive in the area early, please one of our property managers Steve Howard (cell: 850-376-4627) or David Leuze (cell: 850-376-4629) to see if you might be able to go ahead and check in.
CHECKOUT TIME is promptly at 10 a.m., so that we may prepare for our next arrival. Checkout includes tenant and guest, vehicles, luggage and all of Tenant's belongings. Late departure may incur an extra half day rental charge. If the housekeeping staff arrives at 10 a.m. and has to leave and return later to clean our homes because homes have not been vacated, you will be charged a $25.00 trip charge for the housekeeper in addition to any late departure charges that may be assessed.
MAINTENANCE: Please report any maintenance needs for the premises to the owners and we will respond as quickly as possible. Refunds will not be made for maintenance issues including, but not limited to, heating and air conditioning, appliances, televisions, and stereos.
LINENS/TOWELS/SUPPLIES: Although linens are furnished, please bring your own beach towels and beach blankets, as linens are not to be removed from the house. Any lost or damaged linens will be deducted from your security deposit. An initial supply of paper products, trash liners, bathroom tissue and facial soap is provided. Extra items needed are the responsibility of the guest. Cleaning supplies are not provided.
PARKING, located on N. Cartegena Lane, is limited to one space for each house. If you have more than one car, please park in the parking lot across from the house on 30-A. No boats, jet skis, trailers or RVs.
TELEPHONES provided in each home, have long distance call blocks. All long distance charges must be charged to a credit calling card, collect or third party. The telephone number for FishStix is 850-231-0938 and for The Grouper Getaway 850-231-1218.
ADDITIONAL TERMS AND CONDITIONS: The undersigned Tenant, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges FishStix Properties L.L.C. from any and all liabilities, claims, demands and causes of action by reason of any injury, loss or damage by whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result, or in connection with the occupancy of the premises and agrees to hold FishStix Properties L.L.C. free and harmless of any claim or suit arising therefrom. FishStix Properties L.L.C. will not be held responsible for acts of theft or vandalism or other damages to the guest's personal property or items left in FishStix or The Grouper Getaway. Every effort will be made to return any items left, but we assume no responsibility for such items. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs. FishStix Properties L.L.C. reserves the right to terminate this Agreement upon their discretion at any time.

This signature confirms authorization for owner to debit credit card Visa or MasterCard (Please circle one) account #_______________________________ with an expiration date of _______________________ for the Advance Rent Deposit to confirm the reservation, and then at least twenty-one (21) days in advance of reserved date the remaining balance and damage deposit to complete full payment of said reservation. Also note that your credit card will be charged any excess charges above your security deposit if deemed necessary by owner for circumstances described in the agreement. A detailed damage description will be forwarded to renter in case of damage.
